Please read these terms and conditions carefully. By accessing the site you signify your agreement to be bound by these conditions

1. Definitions

1. By "us," "we" and "our" we mean Gingangoo 

2. By "content" we mean the content and information you post or upload on Gingangoo

3. If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect

2. Your Content and Information

You own all of the content and information you post on Gingangoo. In order for you to use Gingangoo you must agree to the following:

1. For content that is covered by intellectual property rights, like photos and videos, you specifically give us the following permission, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any content that you post on or in connection with Gingangoo. This agreement ends when you delete your content or your account (except to the extent your content has been shared with others, and they have not deleted it)
2. When you delete content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others)

3. Operating Conditions

1. We make best efforts keep Gingangoo safe and operational, but we cannot guarantee it. By agreeing to the terms you agree that:

2You will not send or otherwise post unauthorized commercial communications to users eg spam

3. You will not collect users' information, or otherwise access Gingangoo, using automated means eg. harvesting bots, robots, spiders
4. You will not upload viruses or other malicious code
5. You will not solicit login information or access an account belonging to someone else
6. You will not bully, intimidate, or harass any user
7. You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence
8. You will not use Gingangoo to do anything unlawful, misleading, malicious, or discriminatory
9. You will not provide any false personal information or create an account for anyone other than yourself
10. You will keep your contact information private, accurate and up-to-date
11. You will not share your password or let anyone else access your account
12. You will not transfer your account to anyone

4. Protecting Other People's Content Rights

1. We can remove any content you post if we believe that it violates the terms
2. If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate

 5. Disclaimer & Liability

We reserve the right to change, modify, substitute or remove without notice any information on the site from time to time.  We also reserve the right to modify or amend this Agreement at any time, for any reason at our sole discretion  

We update the site regularly however we cannot guarantee that it is completely free of technical errors, viruses or anything else that may effect technology.  We will endeavour to allow continual access to the site but access may be suspended, restricted or terminated at any time.  By using this site, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with this site

In no event shall we be liable for any indirect loss, consequential loss, loss of profit, data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with the terms and conditions or use of the site save where such liability cannot be excluded by law

You agree to indemnify and hold Gingangoo, its subsidiaries, affiliates, successors, assigns, directors, officers, agents, employees, service providers, and suppliers harmless from any dispute which may arise from a breach of Terms and conditions within this Agreement. You agree to hold Gingangoo harmless from any claims and expenses, including fees and court costs, related to any violation of this Agreement

Under no circumstances shall Gingangoo be liable on account of member’s use or misuse of the website, whether the damages arise from use or misuse of the Gingangoo website or from the inability to use the  Gingangoo website, or the interruption, suspension, modification, alteration, or termination of Gingangoo. Such limitation shall also apply with respect to damages incurred by reason of other services or products received through or advertised in connection with the Gingangoo website or any links on Gingangoo, as well as by reason of any information or advice received through or advertised in connection with Gingangoo or any links on Gingangoo. These limitations shall apply to the fullest extent permitted by law

Gingangoo is not responsible for the actions or content of third parties, and you release us, our directors directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties. We will not be liable to you for any lost profits or other consequential, special, indirect, or incidental damages arising out of or in connection with Gingangoo, even if you have beeen advised of the possibility of such damages

 

6. Copyrights, Trademarks, Patents and Intellectual Property Rights

You acknowledge that layout messages, files or other materials contained on the Gingangoo website and within Gingangoo email messages, and third party advertisements on the website and distributed via email, of a commercial nature and presented to you are protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. You may not reproduce, publish, transmit, distribute, copy, post, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the contents, the site, or any related software without our or third party prior written permission.  Nor may you create links to or from the site without our prior written consent

Although Gingangoo does not claim ownership of content that users may provide to Gingangoo, by providing content to users automatically grant, and represent and warrant that they have the right to grant, to Gingangoo a worldwide, irrevocable, perpetual, non-exclusive, and fully sublicenseable, license to use, copy, perform, display, and distribute said content.

 

7. User Information

When registering, users provide personally identifiable information, which includes their first and last name, email address, mailing address, a user-chosen password, and date of birth, and other personal information. We send a validation email message to each user, with a URL link back to our website. This URL contains an alphanumeric identifier and a user-specific numeric code that allows us to confirm the user's identity.

Gingangoo may disclose personally identifiable user information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to court orders, or other legal process. Gingangoo may also disclose information about its users to law enforcement officers or others, in the good faith belief that such disclosure is reasonably necessary to claims that any posting or other content violates the rights of third-parties; or protect the rights, property, or personal safety of Gingangoo, its users or the general public

These terms and conditions do not affect your statutory rights as a consumer
